DMCA Takedown Policy

Introduction

This DMCA Takedown Policy is to be used solely for reporting alleged copyright infringement involving content published on BoxxScore (the "Site"). This policy does not apply to non-copyright matters, including but not limited to privacy complaints, harassment, impersonation, or defamation.

DMCA Notice & Takedown Policy and Procedures

BoxxScore operates in the United States and respects the intellectual property rights of copyright holders. BoxxScore complies with the Notice and Takedown provisions of the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

The Site qualifies as a "service provider" within the meaning of 17 U.S.C. § 512(k)(1) of the DMCA and may be entitled to certain protections from claims of copyright infringement under the DMCA's safe harbor provisions, provided that applicable statutory requirements are met.

BoxxScore respects the intellectual property rights of others and expects users to do the same. Accordingly, BoxxScore has adopted the following DMCA Notice and Takedown Policy relating to claims of copyright infringement by users of the Site.

Notice of Claimed Infringement

If you believe that your copyrighted work has been copied and published on BoxxScore in a manner that constitutes copyright infringement, please submit a written DMCA Notice including the following information:

  • (a) An electronic or physical signature of the person authorized to act on behalf of the copyright owner or other intellectual property owner;
  • (b) A description of the copyrighted work or other intellectual property that you claim has been infringed;
  • (c) Identification of the material claimed to be infringing, including the specific BoxxScore URL(s) where the material appears;
  • (d) Your name, mailing address, and email address;
  • (e) A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • (f) A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright or intellectual property owner or authorized to act on the owner's behalf.

Abuse of DMCA Process

Any person who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability under 17 U.S.C. § 512(f), including damages, court costs, and attorneys' fees.

These DMCA procedures apply solely to copyright infringement claims and do not apply to other disputes or legal claims.

Takedown Procedure

Upon receipt of a valid DMCA Notice, BoxxScore will act expeditiously to remove or disable access to the allegedly infringing material.

BoxxScore reserves the right, in appropriate circumstances, to terminate or restrict access for users who are determined to be repeat copyright infringers.

If a DMCA Notice substantially complies with the requirements of 17 U.S.C. § 512 but contains technical deficiencies, BoxxScore may attempt to contact the complaining party to request clarification or additional information.

DMCA Counter-Notification Procedure

If a user believes that material was removed or disabled as a result of mistake or misidentification, the user may submit a counter-notification pursuant to 17 U.S.C. § 512(g).

Because BoxxScore permits anonymous user submissions, BoxxScore may be unable to directly notify or contact the original uploader of a takedown. Users are responsible for monitoring the Site and submitting any counter-notification they wish to file.

A counter-notification must include the following:

  • (a) Identification of the material that was removed or disabled and the location where it appeared before removal;
  • (b) A statement, under penalty of perjury, that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • (c) The user's name, mailing address, and email address; and
  • (d) A statement that the user consents to the jurisdiction of the U.S. Federal District Court for the judicial district in which the user resides, or if outside the United States, any judicial district in which BoxxScore may be found, and agrees to accept service of process from the person who submitted the original Notice or that person's agent.

Restoration of Content

Upon receipt of a valid counter-notification, BoxxScore will forward the counter-notification to the original claimant. Unless BoxxScore receives notice that the claimant has filed an action seeking a court order to restrain the user from engaging in infringing activity, BoxxScore may restore the removed material within 10–14 business days, consistent with the DMCA.

Modifications to Policy

BoxxScore reserves the right to modify, alter, or update this DMCA Takedown Policy at any time. Affected parties are encouraged to review this policy periodically for changes.
